These Terms and Conditions apply to purchases made through Emma Rodriguez Studio and to the use of this website and any digital or physical products purchased from it.

By purchasing a product from Emma Rodriguez Studio, you agree to these Terms and Conditions and any licence terms stated on the relevant product page.

1. About Emma Rodriguez Studio

Emma Rodriguez Studio provides digital design products, fonts, artwork, prints, custom products and other creative goods.

2. Orders

When you place an order through this website, you are responsible for ensuring that all information supplied during checkout is accurate and complete.

An order is accepted once payment has been successfully processed and an order confirmation has been issued.

Emma Rodriguez Studio reserves the right to cancel and refund an order where there has been an obvious pricing error, technical error, suspected fraudulent activity or another reasonable reason preventing the order from being fulfilled.

3. Digital Products

Digital products may include fonts, templates, graphics, artwork, mockups or other downloadable files.

Digital products are supplied electronically and no physical item will be sent unless the product description specifically states otherwise.

Customers are responsible for checking software compatibility before purchasing.

Font files are generally intended for use with software that supports installed custom fonts, including software such as Photoshop, Illustrator, Affinity Designer and Procreate.

Canva Pro is required to upload custom fonts to Canva.

Emma Rodriguez Studio cannot guarantee compatibility with every application, operating system, device or third party platform.

4. Digital Downloads and Cancellation Rights

Where a digital product is supplied immediately following purchase, you may be asked to expressly consent to receiving the digital content immediately and to acknowledge that your statutory right to cancel may be lost once the download or supply of the digital content begins.

This does not affect your statutory rights where digital content is faulty, incorrectly described or otherwise does not meet applicable legal requirements.

5. Font Licence

Unless a product listing specifically states otherwise, fonts purchased from Emma Rodriguez Studio include a standard commercial desktop licence.

Purchasing a font gives you a licence to use the font. It does not transfer ownership of the font software, font files or underlying intellectual property to you.

The licence belongs to the individual or business that purchased the font and cannot be transferred, sold or given to another person.

The standard commercial desktop licence is perpetual. Once purchased, the licence does not expire and no renewal or recurring licence fee is required, provided the font continues to be used in accordance with the licence terms applicable at the time of purchase.

6. Permitted Font Use

Under the standard commercial licence, you may use purchased fonts for personal and commercial design work.

Permitted uses include:

  1. Branding and logo designs

  2. Packaging

  3. Posters and prints

  4. Social media graphics

  5. Advertising and marketing materials

  6. Editorial design

  7. Printed stationery

  8. Clothing and merchandise

  9. Product packaging and labels

  10. Commercial artwork

  11. Client projects

  12. Digital graphics supplied as completed artwork

  13. Physical products for sale

You may sell products containing lettering created using the font provided that the font is incorporated into a completed design and the original font file cannot be extracted or accessed by the customer.

There is no limit on the number of finished physical products you may produce using the font under the standard commercial licence unless a particular product listing states otherwise.

7. Client Work

You may use Emma Rodriguez Studio fonts when creating work for your own clients.

You may provide your client with completed artwork, outlined lettering, flattened artwork, images, PDFs or other final files that do not contain an accessible copy of the font software.

You must not give, email, upload or otherwise transfer the original font file to a client.

If a client requires the font file so they can edit text themselves, install the font or continue using the font independently, they must purchase their own licence.

A client receiving a logo or brand identity created using an Emma Rodriguez Studio font does not automatically receive a licence to the font itself.

8. Logo and Branding Use

Fonts may be used to create logos, wordmarks and brand identities for yourself or your clients.

A logo or brand identity created using the font may be registered or protected as part of the customer's own brand where legally permitted.

This does not give the customer exclusive ownership of the font, individual characters, alphabet or typeface design.

Emma Rodriguez Studio may continue to sell and licence the same font to other customers.

9. Merchandise and Products for Sale

Fonts may be used on commercial products including prints, clothing, packaging, cards, stationery and other merchandise.

The font must form part of a finished design or composition.

You may not sell individual font characters, alphabet sheets, editable font based assets or products designed primarily to redistribute the font itself.

For example, using a font to create a finished T shirt design is permitted.

Selling a downloadable alphabet containing every character from the font for another person to use as lettering assets is not permitted.

10. Prohibited Font Use

You must not:

  1. Resell a font file

  2. Redistribute a font file

  3. Share a font file with another person or business

  4. Upload a font file to a public download service

  5. Include the original font file within a product you sell

  6. Claim the font itself as your own work

  7. Convert the font into another font format for redistribution

  8. Modify the font and sell or distribute the modified font as a new font

  9. Extract individual characters and resell them as an alphabet, lettering pack or similar asset

  10. Make the font available inside an editable template where another user can type using the font without holding their own licence

  11. Include the font within software, an application, game or similar product unless separate permission has been granted

  12. Use the font as a webfont unless a separate webfont licence has been expressly provided

  13. Place the font file on a server or platform where multiple unlicensed users can access it

  14. Give the font file to a printer, client, contractor or other third party for their independent use unless that person holds their own licence

11. Webfont Use

Webfont use is not included with the standard commercial licence.

Purchasing a font does not give permission to upload or embed the font on a website using formats or technology that allow the font itself to be served to website visitors.

You may still use the font to create static website graphics, images, logos or other artwork where the font has been converted into a finished image and the font file itself is not being served or distributed.

If you require webfont use, please contact Emma Rodriguez Studio before using the font in this way.

12. Editable Templates

You may use Emma Rodriguez Studio fonts when designing templates for your own internal use.

You may not distribute or sell an editable template that requires the original Emma Rodriguez Studio font file to be included or made accessible to the end user.

If a customer needs to edit live text using the font, that customer must obtain their own font licence.

Templates using outlined, flattened or rasterised lettering that cannot be used to reconstruct or access the font may be permitted.

13. Font Modification

You may convert text created using the font to outlines or shapes within design software and make reasonable adjustments to that lettering as part of a finished design.

This includes alterations made when creating logos, artwork, packaging or other creative work.

This does not give permission to modify the underlying font software and distribute, sell or release the modified font as a new typeface.

14. Font Bundles

Where fonts are purchased as part of a bundle, the licence applies to each font included in the bundle unless otherwise stated.

Purchasing a bundle does not grant any additional ownership rights over the fonts.

Fonts purchased individually and fonts purchased within a bundle remain subject to the same restrictions regarding redistribution, sharing and webfont use unless the relevant product description states otherwise.

Fonts released after a bundle purchase are not automatically included in an existing bundle unless this is specifically stated on the product page.

15. Licence Violations

If a font or other digital product is used outside the terms of the licence, Emma Rodriguez Studio may require the user to stop the unauthorised use, purchase an appropriate licence or take other reasonable action to protect its intellectual property rights.

Unauthorised sharing, resale or distribution of font files may result in termination of the licence.

Termination of a licence does not affect any rights or remedies available in relation to previous unauthorised use.

16. Intellectual Property

Unless otherwise stated, fonts, font files, graphics, illustrations, artwork, photographs, mockups, product images, branding, written content and other original material supplied through Emma Rodriguez Studio remain the intellectual property of Emma Rodriguez Studio or the relevant rights holder.

Purchasing a product gives you only the usage rights specifically described by the applicable licence.

You may not reproduce, redistribute, sell or claim ownership of Emma Rodriguez Studio content except where expressly permitted by these terms.

17. Physical Products

Physical products will be described on the relevant product page.

Colours may appear slightly different in person due to variations between screens, printing processes and materials.

Reasonable variation may occur between handmade, custom or made to order products.

Estimated production and delivery times shown on the website are estimates unless expressly agreed otherwise.

Nothing in these terms affects your statutory rights relating to faulty, damaged, incorrectly described or undelivered goods.

18. Custom and Personalised Products

Custom and personalised products are created specifically for the customer based on information supplied at the time of ordering.

Customers are responsible for supplying suitable photographs, names, wording, colour selections and any other information required to complete the order.

Production may be delayed if the required information is not supplied.

Because personalised goods are created specifically for the customer, the normal cancellation right may not apply once production has begun where applicable under consumer law.

This does not affect your statutory rights if a product is faulty, damaged, incorrectly supplied or does not match the agreed description.

19. Custom Pet Portraits

For custom pet portrait products, customers must provide the requested pet information and suitable reference photographs.

Digital pet portraits are normally supplied within the timeframe stated on the relevant product page.

Physical prints are made to order and may require additional production and delivery time.

Customers should carefully check the photograph requirements before submitting their reference images.

If Emma Rodriguez Studio requires additional information or replacement photographs, the customer will be contacted using the contact details supplied with the order.

20. Refunds

Refund rights vary depending on the type of product purchased.

Digital products that have already been downloaded or supplied may not be eligible for cancellation simply because the customer has changed their mind where the applicable requirements regarding immediate digital supply have been satisfied.

Custom and personalised products may also be excluded from ordinary change of mind cancellation rights where permitted by law.

Physical products that are not personalised will be handled in accordance with applicable consumer cancellation rights.

Nothing in these terms removes or limits your statutory rights where a product is faulty, damaged, incorrectly described or otherwise fails to meet legal requirements.

21. Incorrect Purchases

Customers are responsible for reading product descriptions before purchasing.

Please check product format, compatibility, licence restrictions and product specifications carefully.

Where a digital product has already been supplied, refunds will not normally be provided solely because a customer purchased the wrong product, changed their mind or does not have compatible software, except where required by law.

22. Product Images and Colours

Product photography, mockups and previews are intended to provide a reasonable representation of the product.

Colours can vary between screens, printers and production methods.

Mockups may be used to demonstrate how a product could appear in use and may not represent the exact scale, material or surrounding environment of the final product.

Please refer to the written product description for the specifications of the item being purchased.

23. Prices and Payment

Prices are displayed in the currency shown on the website at the time of purchase.

Prices may be changed at any time, but changes will not affect orders that have already been accepted.

Any applicable taxes, delivery charges or other costs will be displayed during checkout where appropriate.

Discount codes and promotional offers may be subject to separate conditions and may be withdrawn or changed at any time before an order is placed.

24. Website Content

You may browse and use this website for personal and legitimate commercial purchasing purposes.

You must not copy, reproduce, scrape, distribute or commercially exploit website content without permission.

You must not interfere with the operation, security or availability of the website.

25. Third Party Services

This website may use third party services for areas such as payment processing, ecommerce functionality, website hosting, analytics, email services and delivery.

Emma Rodriguez Studio is not responsible for interruptions or technical issues caused solely by third party systems outside its reasonable control.

This does not affect any legal responsibilities Emma Rodriguez Studio has to customers.

26. Liability

Nothing in these terms excludes or restricts liability where doing so would be unlawful.

Emma Rodriguez Studio does not guarantee that digital products will be compatible with every piece of software, device, operating system or third party platform.

Customers are responsible for maintaining suitable backups of downloaded digital files.

To the extent permitted by law, Emma Rodriguez Studio is not responsible for losses arising from use of a product in a way that breaches its stated licence or product requirements.

27. Changes to Products and Terms

Emma Rodriguez Studio may update these Terms and Conditions from time to time.

The terms applicable to a purchase will normally be those in effect when the purchase was made.

Updates may be made to clarify licence conditions, reflect changes to products or services or comply with changes in applicable law.

28. Privacy

Personal information supplied through this website will be handled in accordance with the Emma Rodriguez Studio Privacy Policy.

The Privacy Policy should be read separately from these Terms and Conditions.

29. Governing Law

These Terms and Conditions are governed by the applicable laws of England and Wales.

Consumers may also have mandatory legal rights under the laws applicable where they live, which these terms do not remove.
